1. Background
1.1 References to "we", "our" and "us" in this Collection Notice includes C21 Collaborations Pty Ltd, W and J Stewart Pty Ltd, Carkeet Jacobs Smith Pty Ltd, C21 Sales Pty Ltd and C21 PM1 Pty Ltd and any related entities (as defined pursuant to the Corporations Act 2001 (Cth))
1.2 The purpose of this Collection Notice is to explain how and why we collect and may disclose your personal information in the context of a property "open for inspection" that we may conduct.
1.3 By providing us with your personal information, you consent to us collecting and disclosing it as set out in this Collection Notice and our broader Privacy Policy referred to in section 8 below. We will comply with obligations under the Privacy Act 1988 (Cth) (Privacy Act) (including the Australian Privacy Principles (APPs)).
2. Facts and circumstances of collection
2.1 We generally collect your personal information directly from you when you attend a property inspection. We will generally require your name and contact details but may collect additional personal information from time to time.
2.2 In some cases, we may have already received some of your personal information (for instance, where you have previously contacted us about the property or otherwise had prior dealings with us).
2.3 We may also have collected your personal information from your enquiries directed to us via third party property marketplaces such as Domain or realestate.com.au.
3. Purposes of collection
3.1 Primary purposes for collection of your personal information at property inspections are:
(a) to ensure the safety and security of property owners, existing occupiers and their property in connection with the inspection;
(b) to ensure we are able to comply with our general professional obligations as well as any specific obligations under the Property and Stock Agents Act 2002 (NSW), Property Stock Agents Regulation 2022 (NSW), other relevant laws and our authority to exercise functions in relation to the property under the relevant agreement with the property owner; and
(c) to register your interest in the property to provide you with further information, details and updates in relation to the property that you are inspecting, unless you tell us not to.
3.2 Secondary purposes for collection of your personal information at property inspections are:
(a) for marketing purposes including to advise you of other available properties, or services that we or our related entities may provide, unless you tell us not to;
(b) to enable us to run our business efficiently, to update records and to perform administrative and operational tasks; and
(c) in order to manage or improve our services and relationships including for statistical or data analysis purposes.
4. Consequences if personal information is not collected
4.1 If you do not disclose the required personal information at a property inspection then we may:
(a) as custodian of the property, be unable to permit your access for the purpose of conducting an inspection;
(b) be unable to register your interest in and keep you updated in relation to the property;
(c) be unable to perform our functions and assist you with your requirements or satisfy your requests to the appropriate service level or at all; or
(d) be unable to provide you with other valuable information or services on offer.
5. Usual Disclosures
5.1 Your personal information may be disclosed as a part of providing our functions and activities, including to:
(a) any conjunction, co-listing agent, auctioneer or property owner, where necessary;
(b) your representatives or agents that act on your behalf in connection with the leasing or purchase of property;
(c) any contractors or third parties we engage to assist with the provision of our services;
(d) marketing, advertising and promotions services providers and event organisers in connection with our marketing, advertising or events;
(e) service providers of other administrative or operational services to us, such as market research companies or IT service providers; and
(f) law enforcement or government agencies or other third parties, if permitted or required by law.
5.2 Under no circumstances will we sell or receive payment for licensing or disclosing your personal information.
6. Cross-border disclosures of personal information
6.1 We may use the services of certain third-party service providers which may have offices or other operations outside of Australia. As a result, your personal information may be disclosed to overseas recipients.
6.2 Under the Privacy Act, we must take reasonable steps, before personal information is disclosed to an overseas recipient, to ensure that the overseas recipient does not breach Australian privacy laws in relation to that information (the Obligation).
6.3 The Obligation does not apply if you consent to disclosure of your personal information to an overseas recipient. By supplying personal information to us you consent to the disclosure of your personal information to an overseas recipient and agree that the Obligation does not apply.

7.1 Our Privacy Policy contains information about how you may access your personal information and seek correction of such information as well as how to complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint.
